When it comes to child protection I'll have to do things such as seek a written permission from the parents if I want to photograph them, make sure that the parents are present with the child at any photography sessions and never use their name in the photos on websites and promotional materials.
Data Protection is classed mainly as legal issues but some ethical issues come into play too. The protection is apart of the DPA (Data Protection Act) and is a law placed to protect a certain persons data, this can be things such as their photos, name, address, credit history etc. that are placed in computer databases, these can be easily accessed and edited, businesses can easily get a hold of this information, if the company that has it sells it or uses it without your permission, they have violated the law. A photography company that wants to avoid violating the act, they would need to apply this to the information commissioner before storing any of this kind of data. They need to declare what the information that they're going to store is and how it will be used, they also need to declare how it will be kept safe. Finally, they need to agree that they won't use the information in any other way than they agreed to, including photographs.
If I collect data from people I am photographing I have to tell them what it will be used for, how I will store it and how
long I will keep it for. I need store
photographs away safely especially if they can be used to identify people as
this will be classed as sensitive personal data. And finally I always get consent when taking
photos as this is classed as data.
Copyright is the law that protects a producer's intellectual property they have created, this means someone else can't use your property without your consent, and the same goes for you asking some one else to us theirs. Things that can be considered Intellectual property are; Music recordings, video recordings (for things like film and TV), literacy work (Anything to do with illustrations such as a book), Art work or photography work.
You can put a patent on a piece of intellectual protect, the person who owns the patent can take action against anyone who try to re-make, sell or import your work, this works by registering the look or design of a product, this is the appearance, physical shape , configuration and decoration of the product. Creative commons is an organisation that do not make money and are used as a way of using copyright free material, specifically music and photos. I will not have to worry about my photos infringing copyright as my photos will be my own work and will not include anything that needs to be approved by a producer of an intellectual property.
Model Release is a legal document signed by the model that you are taking a photo of, this gives permission to publish a photo with their identity. The legal document is called a 'Model release form' and the model signs this to agree with a set terms and conditions and you need this so that you have proof of the model agreeing with you to use their identity. I will not need to get permission for the use of a model in my photo, as my photos are took in the forest and involve no models at all, and so this means I do not need to get a model to sign the release form.
Public space and private space are what a location are classed as, if the location is open to the public and you do not need to seek permission to photo shoot their, then it's a public space, but if you take the photo and someone is walking by, and you still want to use the photo, then you need to get their permission through a model release form. On the other hand, their is private spaces, and this is when a location is owned by someone, their are some exceptions, such as you can take a photo of a private building or private land, as long as you are not on the land that is owned. If the case is that you are on private land, then you need to get a location release form, this is signed by the land owner as a binding contract with the photographer, granting permission for use of their land to take photos (This can also go for shooting a movie, video or commercial). I will not need to get any permission by using a location release form because the land I am shooting on is a public forest where anyone can enter and walk through.
Misrepresentation is an ethical issue that you have to look out for in a photo. Defamatory is when you represent a model in a negative way by representing them as a person who they are not. You also have to avoid misrepresenting stereotypes negatively, this includes; races, religions, cultures, abilities and disabilities. You should not misrepresent them as it can be found very offensive. I will not have to worry about misrepresenting any of these things because I will not be using a model, or anything else that I could use to misrepresent, as I am taking pictures in the forest of trees, plants and nature.
